Dutyholders

The most significant change introduced by the Building Safety Act (BSA) was the introduction of specific duties for all those who either carry out design work or undertake construction work, along with the creation of three key duty holder roles: the client, principal designer, and principal contractor.

 

Accountability is the common theme throughout all the changes made by the BSA. The intent is to implement mechanisms within the law to identify who is responsible at each stage during the design and construction of building work and, of course, once a building is occupied. Fire Safety Legislation

From the 1 October 2023, Section 156 of the Building Safety Act 2022 made changes to The Regulatory Reform (Fire Safety) Order 2005 that will affect all Responsible Persons.


These changes have been made following the Grenfell Tower tragedy, which provoked the need for change amongst the built environment. The updates will improve the fire safety in non-domestic premises and any premises that contain two or more domestic dwellings (referred to as multi-occupied residential buildings).

Gateways

The new ‘gateways’ are the building control process for higher-risk buildings. The key aspect of this new process is that you will need building control approval from the Building Safety Regulator before you start work.

 

These need careful planning within the construction programme as well as bringing design development forward to ensure building control approval can be secured before any building work starts on site.
